1. Objet

These General Terms and Conditions of Sale (GTCS) govern all reservations and services offered by HOTEL BRIN D’AZUR (hereinafter “the hotel”). By booking a stay or a service, the customer fully accepts these terms and conditions.

2. Booking

2.1 Booking procedure

2.2 Booking confirmation

A reservation is confirmed only after receipt of a guarantee, either in the form of a deposit, or by the transmission of credit card details.

3. Rate

3.1 Room rates

Rates include applicable VAT. Tourist tax is charged in addition, in accordance with current regulations.

3.2 Price changes

Rates are subject to change without notice, but the prices confirmed at the time of booking remain guaranteed.

3.3 Additional services

Additional services (breakfast, parking, spa, etc.) are billed as extras, according to the rates displayed at the time of booking.

4. Payment methods

  • Payments can be made by credit card or in cash.
  • The balance of the stay must be paid on arrival or departure, according to the terms agreed at the time of booking.

5. Cancellation and modification conditions

5.1 Cancellation by the customer

  • Free cancellation: Up to 1 day before the arrival date (unless otherwise stated in the offer booked).
  • Late cancellation: If cancellation occurs after this time, a penalty equivalent to 100% of the total amount of the stay or the first night without extras will be charged.

5.2 No-shows

In the event of a no-show, the full amount of the stay will be invoiced.

In the event of a no-show on the day of booking :

  • The contract is automatically cancelled.
  • In accordance with articles 1590 of the French Civil Code and L 214-1 of the French Consumer Code, the Establishment will retain all sums paid by the Customer at the time of booking as a deposit.
  • For non-cancellable / non-exchangeable / non-refundable reservations, the deposit corresponds to the total amount of the reservation, including the options selected.

5.3 Booking changes

All requests for changes will be processed according to the hotel’s availability and may incur additional charges.

6. Rules and regulations

Guests agree to abide by the hotel’s rules and regulations:

  • Smoking is strictly prohibited in designated non-smoking areas. Smoking areas are located outside the hotel, where ashtrays are available, as well as on the outdoor terraces. Failure to comply with this rule will result in a fine of €250.
  • Any damage or loss caused by the customer will be billed.

7. Hotel liability

HOTEL BRIN D’AZUR declines all responsibility in the event of :

  • Theft or loss of objects in rooms or common areas.
  • Damage caused by external events (force majeure).

8. Personal information

Information collected in connection with bookings is processed in accordance with legislation on the protection of personal data (RGPD). The customer has a right of access, rectification or deletion by contacting [email protected]

9. Disputes

In the event of a dispute, the customer is invited to send a written complaint to [email protected]. Failing amicable agreement, the dispute will be submitted to the exclusive jurisdiction of the competent court.
